1. Seller and scope

Movo Bags (MOVO) is operated by Jordi Olaechea Martinez, a sole trader, Spanish tax identification number (NIF) 26070088W, at Carrer del Bruc 90, 3-3, 08009 Barcelona, Spain. Contact: hello@movobags.com; +34 636 938 788.

These terms govern use of movobags.com and purchases from MOVO. The product information, prices and policies provided before your order form part of the purchase contract. Nothing in these terms excludes or limits mandatory consumer rights. Business and resale orders may have separately agreed written commercial conditions; these do not remove any mandatory rights that apply.

2. Accounts and information

You must have legal capacity to make a purchase and provide accurate contact, delivery and payment information. Keep account credentials secure and notify us of suspected unauthorised access. You are responsible for activity you authorise through your account, without limiting rights relating to unauthorised payments or security failures under applicable law.

3. Products and orders

Check the product description, dimensions, contents, availability and final order details before purchasing. Screen settings may affect how colours appear, but this does not remove the requirement that goods conform to the contract. Product and price changes apply to future orders and do not unilaterally change an accepted order.

Placing an order submits a purchase request with an obligation to pay. Acceptance and payment status are communicated in the order confirmation process. If an item is unavailable, payment cannot be processed or a material error prevents fulfilment, we will contact you. We will not substitute products or impose a higher price without your agreement. If we cannot fulfil an order and it is cancelled, we will refund any sums collected without undue delay. Your statutory cancellation and other remedies remain available.

4. Prices, payment and promotions

Consumer prices displayed in the store include applicable taxes. The final total, currency, any delivery cost and available payment methods are shown before you commit to payment. Shipping to the 27 EU countries is free. You will not be charged optional extras without your express agreement.

Discounts are subject to the stated code conditions, eligibility and validity dates. A promotional condition cannot remove statutory consumer rights. Separately negotiated business quotations state their own tax and delivery treatment and do not change the public retail price.

5. Preparation, delivery and risk

Order preparation takes 3 business days. Carrier transit is 2 business days in Spain and 3–5 business days in other EU countries. Estimated total delivery is approximately 5 business days in Spain and 6–8 business days in the rest of the EU. Business days are Monday to Friday, excluding public holidays. For consumer orders shipped by a carrier offered by MOVO, the risk of loss or damage remains with MOVO until you or a person you designate, other than the carrier, takes physical possession. If you independently appoint a carrier not offered by MOVO, the statutory exception concerning transfer of risk to that carrier applies. Delays do not remove your statutory rights, including rights to require delivery or terminate the contract in the circumstances provided by law.

6. Returns and statutory withdrawal

You may request a return within 30 calendar days after receipt. MOVO pays return shipping, including change-of-mind returns, provides a prepaid return label and charges no restocking fee. The conditions of the additional commercial return period and the separate statutory 14-day right of withdrawal are set out in our return and refund policy, including the withdrawal procedure and optional model form. Commercial return conditions do not restrict statutory withdrawal or rights concerning defective goods.

7. Conformity and legal remedies

Goods must conform to the contract. If a product is faulty, incorrect or non-conforming, contact us at hello@movobags.com. Applicable statutory rights, including repair, replacement, price reduction or termination where their legal conditions are met, remain unaffected. Where Spanish consumer law applies, the seller is responsible for a lack of conformity in new goods that becomes apparent within three years of delivery. Mandatory protection under the law applicable to the consumer is preserved. The 30-day commercial return period is not a limit on these rights.

8. Intellectual property

Store content, designs, images, text and trademarks belong to MOVO or the relevant rights holders and are protected by applicable intellectual property law. You may use the website for lawful shopping and information purposes. No ownership or general licence to reproduce or commercially exploit that content is transferred. Any rights and exceptions provided by law remain unaffected.

9. Shopify and third-party services

Shopify provides the technology that hosts this store. Products are sold by MOVO, and MOVO is responsible for the sales contract. A link, tool or service provided by a third party may be subject to that provider's terms and privacy policy. Check them before using the service. Third-party involvement does not exclude responsibilities or rights that cannot lawfully be excluded.

10. Privacy and communications

Our privacy policy explains the processing of personal information, including Shopify, analytics and your choices and rights. We use the contact details provided to communicate about orders and relevant service matters. Accepting these terms is not, by itself, consent to marketing or non-essential cookies. Marketing preferences and cookie consent can be managed as described in the privacy policy.

11. Reviews and feedback

Reviews and feedback must reflect genuine experience and must not be unlawful, misleading, abusive or infringe another person's rights. You retain ownership of your content. By submitting it for publication, you allow MOVO to display it and make reasonable formatting changes for that purpose. We may remove content that violates these rules or the law, without presenting edited feedback as a different customer opinion. Personal information is handled under our privacy policy.

12. Lawful use and automated tools

Do not use the store for fraud, unlawful activity, infringement, harassment, malicious software, unauthorised access, disruption or bypassing security controls. Do not impersonate another person or submit false payment or identity information.

If you authorise an automated assistant to act for you, it may act only within that authority and must respect these terms and technical safeguards. Automated access does not create special discounts, commitments or rights to personal information. Mandatory accessibility, consumer and data protection rights remain unaffected.

13. Errors and availability

We may correct inaccurate website information and temporarily restrict access for maintenance or security. A correction does not permit us to retrospectively remove an agreed contractual right. If an error affects an order, we will explain it and seek an appropriate resolution, including a refund where the order cannot be fulfilled. We do not guarantee uninterrupted website availability.

14. Responsibility

Each party is responsible in accordance with applicable law. No website availability disclaimer or other clause excludes liability that cannot lawfully be excluded, statutory product conformity, fraud, wilful misconduct or applicable rights in relation to personal injury. You are not required to indemnify MOVO for its own unlawful acts or failures. Any claim for loss arising from unlawful use of the store remains subject to applicable law and proof of the relevant facts.

15. Access restrictions and termination

We may restrict access or suspend an account where reasonably necessary to address fraud, security risks or a breach of these terms. Such action does not extinguish obligations relating to an accepted order, refunds or other mandatory rights. Provisions that by their nature continue, such as intellectual property and accrued rights, remain effective to that extent.

16. Applicable law and disputes

Spanish law governs these terms. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your habitual residence that apply under the relevant conflict-of-law rules. The courts with jurisdiction are those determined by applicable law. In particular, this clause does not require consumers to waive the courts available to them under mandatory consumer jurisdiction rules. No exclusive business forum is specified by these terms.

17. Language, severability and changes

These terms and policies are provided in English, Spanish and German with equivalent content. No language version takes priority in a way that removes mandatory consumer protection. Any ambiguity is interpreted as required by applicable law. If a provision is invalid, the remaining terms continue only to the extent permitted by law; no invalid provision is used to reduce statutory rights.

We may update terms for future use and future purchases. The terms provided for an accepted order continue to govern that order unless a lawful change is expressly agreed. Failure to enforce a right immediately is not a general waiver. Any transfer of contractual rights or obligations remains subject to applicable law and may not reduce mandatory consumer rights.
